1. Acceptance
By using autoshopper.co.nz ("the Site") you agree to these Terms & Conditions. If you do not agree, do not use the Site.
2. The service
AutoShopper NZ provides a platform for private sellers to list vehicles for sale and for buyers to browse and enquire about those vehicles. We are not a party to any transaction between buyers and sellers. We do not inspect, warrant, or guarantee any vehicle listed on the Site.
3. Accounts
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 18 years old to list a vehicle for sale.
- We may suspend or terminate accounts that violate these terms.
4. Listings
- You must be the legal owner (or authorised agent) of any vehicle you list.
- Listings must be accurate and not misleading. Misrepresenting a vehicle's condition, history, or specifications is prohibited.
- We reserve the right to remove any listing that violates these terms or applicable law.
- Listings are free for private sellers. We may introduce paid features in the future with notice.
5. Communication between users
Important — Email disclosure: When a buyer sends an enquiry via the Site, the message is forwarded to the seller's contact email. The buyer's email address is included in the reply-to field. By replying, the seller's email address becomes visible to the buyer. Both parties consent to this email exchange by using the enquiry feature.
AutoShopper acts only as an intermediary for the initial message. We are not responsible for any subsequent communication, negotiation, or transaction between parties.
6. Prohibited conduct
- Listing stolen vehicles or vehicles you do not own
- Posting fraudulent, misleading, or spam content
- Harassing other users via the enquiry system
- Scraping, automated access, or any use that degrades Site performance
- Using the Site for any unlawful purpose
7. Limitation of liability
AutoShopper NZ is provided "as is" without warranty. To the maximum extent permitted by New Zealand law:
- We are not liable for any loss arising from transactions between users.
- We are not liable for the accuracy of listing information provided by sellers.
- We are not liable for any indirect, consequential, or incidental damages.
- Our total liability is limited to the amount you have paid us (if any) in the 12 months preceding the claim.
8. Indemnity
You agree to indemnify and hold harmless AutoShopper NZ, its operators, and affiliates from any claims, losses, or damages arising from your use of the Site, your listings, or your interactions with other users.
9. Intellectual property
All Site content, branding, and design is owned by AutoShopper NZ. Vehicle data is sourced from the NZTA Motor Vehicle Register. User-uploaded photos remain the property of the uploader but you grant us a licence to display them on the Site.
10. Privacy
Your use of the Site is also governed by our Privacy Policy.
11. Governing law
These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
12. Changes
We may update these terms at any time. Continued use of the Site after changes constitutes acceptance.
